Acceptance and eligibility
By creating an account, purchasing a gift box, opening a recipient link, or continuing to use Send A Smile Online, you agree to these terms. You must be legally able to enter this agreement. If you use Send A Smile Online for an organisation, you confirm that you have authority to bind it.
The service
Send A Smile Online is a digital gifting service operated by Lokul tech and marketing. Senders create virtual gift boxes, add recipient details and messages, and choose delivery timing. Recipients use a private link to select one available virtual item and reveal a message. Virtual items have sentimental and entertainment value only and are not physical food, flowers, or merchandise.
We grant you a limited, non-exclusive, non-transferable, revocable right to use Send A Smile Online for its intended purpose under the purchased offering. We do not guarantee that the service will always be uninterrupted, secure, or error-free.
Accounts and information
Senders must provide accurate information, keep it current, protect account credentials, and remain responsible for activity under their account. Recipient links are private and should be shared only with the intended recipient.
Acceptable use
You must not use Send A Smile Online to:
- break the law, threaten or harass others, commit fraud, send spam, or impersonate another person;
- upload or send content you do not have the right to use, or infringe intellectual-property, privacy, or other rights;
- introduce malware, probe or interfere with security, scrape the service, evade limits, or disrupt other users;
- reverse engineer, resell, redistribute, or commercially exploit the service except with our written permission.
Your messages and recipient details
You retain ownership of content you submit. You give Lokul tech and marketing a limited licence to host, process, display, and deliver it solely to operate and improve Send A Smile Online. You are responsible for your messages, for having the right to provide recipient contact details, and for choosing appropriate recipients. We may remove or restrict unlawful or abusive content.
Our intellectual property
Lokul tech and marketing retains all rights in Send A Smile Online, including its software, design, documentation, content library, branding, and related intellectual property. No ownership transfers to you under these terms.
Purchases, billing, and refunds
Prices and the contents of your order are shown before checkout. Orders are sold directly by Lokul tech and marketing, and card payments are processed securely by our payment provider, Stripe. Any applicable sales tax or VAT is calculated at checkout.
Cancellation and refund mechanics are set out in our Refund Policy, and customer-service requests are handled by us. A gift box is activated for delivery only after payment is confirmed, unless an authorised promotional or administrative exception applies.
Suspension and termination
We may suspend or end access for a material breach, non-payment, security or fraud risk, unlawful conduct, or repeated or serious policy violations. You may stop using Send A Smile Online at any time. When access ends, gift links may stop working and data may be deleted after any legally required retention period.
Warranties and liability
To the fullest extent permitted by law, Send A Smile Online is provided “as is” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Lokul tech and marketing is not liable for indirect, incidental, special, or consequential losses, including lost profits, data, or goodwill.
To the fullest extent permitted by law, our total liability relating to Send A Smile Online will not exceed the fees you paid us during the six months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, death, or personal injury caused by negligence where applicable.
Changes
We may update these terms to reflect service or legal changes. Continuing to use Send A Smile Online after updated terms take effect means you accept them. If a change materially affects a paid order, applicable law and your statutory consumer protections continue to apply.
